These terms and conditions are agreed upon between Sítio das Artes and individuals wishing to make a purchase through the website www.sitiodasartes.com, hereinafter referred to as "the customer."
The parties agree that their relationship will be exclusively governed by this contract, excluding any prior terms available on the website.
Sítio das Artes undertakes to comply with all current legislation regarding distance selling and e-commerce, particularly Decree-Law 143/2001, as well as any other applicable legal provisions.

SECTION 1 – OBJECTIVE

These terms aim to define the terms of sale between Sítio das Artes and the customer, covering the process from order placement to services, payment, and delivery.
They regulate all necessary steps to place an order and ensure the follow-up of the order between the contracting parties.

SECTION 2 – ORDER FORM

The customer may submit their order via:

  • Online catalog;
  • Email - only for items not listed in the online catalog.

By submitting an order, the customer fully and unreservedly accepts the prices, product descriptions available for sale, and the general sales conditions, which shall be the only applicable terms for the concluded contract.
Any disputes regarding this will be resolved through a negotiated solution with the guarantees mentioned below.
Sítio das Artes will fulfill online orders only up to the limits of available stock. If the product is unavailable, Sítio das Artes commits to informing the customer as soon as possible.

SECTION 3 – PRICES

Prices, inclusive of taxes, are displayed in euros.
The prices reflect the VAT rate applicable on the order date. Any changes to the VAT rate will be reflected in the product prices.
Prices may be changed at any time following this date.

SECTION 4 – WARRANTIES

Any item can be exchanged or refunded within 14 days from the invoice date, provided it is returned in its original packaging, accompanied by a copy of the invoice, and in the same condition as sold.
The customer is responsible for shipping costs incurred due to exchanges or returns for dissatisfaction.
If the exchange or return is due to an error by Sítio das Artes, shipping costs will be reimbursed to the customer.
Items sold by the meter and perishable goods (e.g., paints) are not eligible for exchange.
If the new order costs more than the original, the customer must pay the difference, either upon placing the exchange request or at the time of pickup. If the exchange costs less, and the customer paid in cash or by credit card, they will receive a refund for the difference.
In the case of a refund request for an item delivered for free or at a reduced price due to a special offer, Sítio das Artes will reimburse part of its commercial value, not the total value.
All exchange or refund requests must be made via post or email.
All items are subject to a contractual warranty, which does not affect the legal warranty.

SECTION 5 – LIABILITY

For all stages of website access, order processing, delivery, or subsequent services, Sítio das Artes is only bound by an obligation of means.
Sítio das Artes excludes all warranties and liabilities for inconveniences or damages inherent to using the Internet, particularly service interruptions, external intrusions, viruses, or any force majeure events as classified by the courts, to the extent permitted by applicable law.

SECTION 6 – PERSONAL DATA PROCESSING

The customer authorizes Sítio das Artes to process their personal data provided in the purchase order automatically.
In compliance with Law no. 67/98 of October 26 (Personal Data Protection Law), the customer may, at any time, exercise their rights to access, rectify, cancel, or oppose by sending a request via post or email.

SECTION 7 – ENTIRE AGREEMENT

These terms of sale constitute the entire agreement between the parties.
If any clause of this contract is declared null due to legislative, regulatory, or judicial changes, the validity of the remaining terms remains unaffected, and compliance with these General Sales Conditions is mandatory.

SECTION 8 – DURATION

These terms apply throughout the period of online availability of the services offered by Sítio das Artes.

SECTION 9 – EVIDENCE

Digital records stored in Sítio das Artes' and its customers' computer systems are considered proof of communications, orders, and payments made between the parties.

SECTION 10 – APPLICABLE LAW AND JURISDICTION

This contract is governed by Portuguese law. In case of dispute and the absence of an amicable resolution, jurisdiction is assigned to the competent courts of Portugal, irrespective of the number of defendants or type of procedure.

User registration on the Sítio das Artes website is essential for processing an order. Registration is also crucial for users who wish to make future purchases without having to re-enter all their details, thus simplifying the entire purchasing process.

To begin placing an order, you must log in. If you are not yet registered in our online store, now is the time to do so; otherwise, the system will not recognize your shopping list.

To purchase a product, add it to the shopping cart by clicking the "Buy" button. The shopping cart will then display the products added so far. To continue adding products, click "Continue Shopping." You can also remove items and update quantities of the products already added.

To finalize your order, click the "Finalize Order" button.

The checkout process is completed in three steps:

  1. Choose the payment method
  2. Choose the delivery method
  3. Confirm the details and total order amount

After confirming the order, you will receive an email with all the relevant information.

In your user area, you can view all your orders and their statuses.

Sítio das Artes offers users several payment methods:

  • Bank Transfer
  • Multibanco
  • PayPal
  • MBWay
  • Credit Card

The user will pay a total amount that corresponds to the order processing costs. Additional charges consist of fixed expenses such as a contribution to packaging and shipping costs unless benefiting from a special offer that waives such payment.

If the products are out of stock, the user's account will only be charged for the products that are actually shipped.

Orders will be delivered to the address provided by the user at the time of placing the order.

Deliveries are made via CTT – Correios de Portugal for orders up to 2 kg, and via CTT Expresso (EMS) for orders weighing more than 2 kg.

All orders are sent via registered mail, and Sítio das Artes is committed to delivering the ordered items as quickly as possible.

To track an ongoing order online, users can request the registration number of their order.

The maximum delivery time is 1 to 10 working days, including processing and transportation, starting from the payment confirmation. The indicated timeframes may be subject to changes due to unforeseen circumstances.
If any of the products you added to the shopping cart are out of stock, without this information being available in our online store, the order will not be shipped without your authorization. Therefore, we will contact you by phone or email to get your feedback.

After the issuance of the CTT pickup notice, the customer has up to 6 working days to collect the order. After this period, if the order is not claimed by the recipient, it will be returned to the sender.

Reshipping the order will require the customer to pay the shipping fees again.

According to the Portuguese E-Commerce Association, shopping online is as safe as purchasing a product or service in a physical store. Modern electronic systems provide the same level of trust as a restaurant, a newsstand, or a shop where you regularly purchase your products, with the added advantage that everything is electronically recorded.

Moreover, most online stores today offer various secure payment methods, such as bank transfers, PayPal, and Multibanco.
